I knowingly and freely assume and accept all risks in connection with my, together with any associated person’s or child’s (my “associates”), participation in and/or use of this app and associated AR experiences, including, without limitation, any harm, injury, loss or damage to person or property that may be suffered or sustained as a user of the app or participant in the AR experiences, whether such risks are foreseen or unforeseen, predictable or unpredictable, discussed or unstated, inherent or otherwise. I understand and acknowledge that the use of this app and participation in the associated AR experiences will take place in various environments, places and neighborhoods, such as recreation fields or centers, parks, streets or other roadways, and may involve proximity and exposure to and/or contact with trash, litter and other known or unknown substances, as to which it is impossible to foresee or predict specific risks or dangerous conditions and to have taken precautionary measures. I will remove myself and my associates from any situation or activity which I feel may be dangerous or pose a risk to myself or my associates. In consideration for my and my associates’ use of the app and participation in the AR experiences, I, on behalf of myself and my associates, release Fiera Studios, LLC, Philadelphia Mural Arts Advocates, Beyond the Bell Tours, LLC, and Michelle Angela Ortiz and each of their respective employees, contractors, and agents (the “Releasees”) and hold them harmless from, and waive and discharge, all claims, actions and losses for, or resulting from, any bodily injury, property damage, disability, death, illness, or disease incurred by myself and/or my associates, however occurring and even if arising out of, or in connection with, the negligence of Releasees. I HEREBY AGREE NOT TO SUE OR MAKE CLAIMS AGAINST ANY RELEASEE AND GIVE UP ALL OF MY RIGHTS TO DO SO.

This Disclaimer and Release constitutes the entire agreement between me and the Releasees concerning the subject matter hereof and supersedes any prior agreements or understandings I may have regarding the subject matter hereof. This Disclaimer and Release: will remain in effect until terminated or replaced with a new written agreement; will be binding upon me and my associates, together with our estates, heirs and personal representatives; will inure to the benefit of each Releasee, and each Releasee is a third party beneficiary hereof; is governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law provisions. I certify that the information I have provided to the Releasees regarding myself and each of my associates is true, correct and complete.
